Form 45 report in Illinois Worker's Compensation Commission

 

Under §6(b) of the Illinois Workers' Compensation Act the employer is required to report and file in writing with the Commission a report of all accidental deaths, injuries and illnesses arising out of and in the course of employment resulting in loss of more than three scheduled work days.  However, minor injuries requiring only first aid treatment and which do not involve medical treatment, loss of consciousness, restriction of work or motion or transfer to another job are excluded from this requirement.  According to the Illinois Worker's Compensation website, the employer has this duty but the insurer acting on their behalf also is required to file if the employer has not.  If the accident is a fatal accident it must be reported within two days after the death.  Any non-fatal cases shall be reported within one month.  Form 45 is available online at the Illinois Worker's Compensation website.  Section 6(b) also outlines what should be included in the report.
